Terms & Conditions for Artwork Sales and Commissions

1. General

These Terms & Conditions apply to all purchases of artworks and services from Erin Hung Studio / Roots Art Collective Limited ("the Artist"), including works acquired through art fairs, online platforms, direct sales, and commissioned projects. By purchasing or commissioning work, the client ("the Buyer") agrees to the terms outlined below.

2. Artwork Sales (Art Fairs & Online)

  • All artworks are sold as described at the time of purchase. Minor variations in color, scale, or material may occur due to display differences or handcrafted processes.

  • Prices are listed in the stated currency and are subject to change without prior notice.

  • Full payment is required at the point of purchase unless otherwise agreed in writing.

  • Purchased artworks are non-refundable and non-exchangeable, except in cases of proven damage during transit (see Section 5).

3. Commissions

  • Commission projects are confirmed only upon receipt of a non-refundable deposit (typically 50% of the total fee unless otherwise specified).

  • The remaining balance is due prior to delivery, installation, or release of final files.

  • The Artist retains creative direction over the final outcome while aligning with the agreed concept, scope, and materials.

  • Reasonable revisions may be included as outlined in the project agreement; additional revisions may incur extra fees.

  • Any significant changes to scope, timeline, or deliverables requested by the Buyer may result in revised pricing and timelines.

4. Intellectual Property & Usage Rights

  • The Artist retains full copyright and intellectual property rights for all artworks and designs, including commissioned works, unless explicitly transferred in writing.

  • Purchase of an artwork does not grant the Buyer the right to reproduce, distribute, or commercially exploit the work without prior written consent.

  • The Artist reserves the right to document, reproduce, and publish images or videos of the work for portfolio, exhibitions, publications, and promotional purposes.

5. Shipping, Delivery & Installation

  • Shipping costs, insurance, and any applicable taxes or duties are the responsibility of the Buyer unless otherwise agreed.

  • Delivery timelines are estimates and may be affected by production schedules or external factors.

  • The Buyer is responsible for inspecting the artwork upon receipt. Any damage must be reported within 48 hours with photographic evidence.

  • For installations, site access, permits, and safety compliance are the responsibility of the Buyer unless otherwise specified.

6. Ownership & Risk

  • Ownership of the artwork transfers to the Buyer only upon full payment.

  • Risk of loss or damage passes to the Buyer upon delivery or collection.

7. Cancellations

  • Orders for completed artworks cannot be cancelled once payment has been made.

  • Commission deposits are non-refundable. If a commission is cancelled after work has begun, the Artist reserves the right to retain all payments made to date, proportional to work completed.

8. Force Majeure

  • The Artist is not liable for delays or failure to perform due to circumstances beyond reasonable control, including but not limited to natural events, supply chain disruptions, or government restrictions.

9. Governing Law

  • These Terms & Conditions are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region.
